These Terms of Service (“Terms”) govern your use of the website built-by-micah.com (the “Site”) and any inquiries or services you engage through it, including our web design and AI automation services. By accessing or using the Site or our services, you agree to these Terms. If you do not agree, please do not use the Site.
1. About Our Services
Built By Micah provides web design services and AI automation services (including Missed Call Text-Back, Speed to Lead, and AI Review Request & Response) for small and local businesses. Information on the Site, including package descriptions and pricing, is for general informational purposes and is not a binding offer. Any project or automation service we provide is governed by a separate signed agreement, which controls if there is any conflict with these Terms.
2. Quotes & Pricing
Prices and packages shown on the Site are estimates and may change. Your final price and scope are confirmed in a signed agreement before any work begins or any automation is activated.
3. Automation Services — Billing, Cancellation & Your Responsibilities
Our AI automation services (Missed Call Text-Back, Speed to Lead, AI Review Request & Response, and the AI Automation Suite) are billed monthly following a one-time setup fee, with no long-term contract. You may cancel at any time, effective at the end of your current billing cycle; we do not provide refunds for partial months already billed. You are responsible for any third-party costs incurred to run your automations (such as SMS/text messaging or phone carrier fees). You are solely responsible for ensuring you have the legal right and proper consent to contact your own customers by text or phone, including compliance with the Telephone Consumer Protection Act (TCPA) and any applicable state or local laws. Built By Micah provides the automation tooling but does not guarantee any specific business outcome, response rate, or increase in leads, reviews, or revenue.
4. Intellectual Property
All content on the Site including text, graphics, logos, and design is owned by Built By Micah or its licensors and may not be copied, reproduced, or reused without written permission. Ownership of completed client websites and automations is addressed separately in the signed client agreement.
5. Acceptable Use
You agree not to misuse the Site, including attempting to gain unauthorized access, disrupting the Site, scraping or copying its content, or using it for any unlawful purpose.
6. Third-Party Tools & Links
The Site and our automation services may use or link to third-party tools (such as Calendly, Stripe, Google, Twilio, or social media platforms). We are not responsible for the content, policies, or availability of those third-party services.
7. Disclaimer
The Site is provided “as is” and “as available,” without warranties of any kind. We do not guarantee that the Site will be error-free or uninterrupted, that information on it is complete or current, or that our web design or automation services will produce any specific business result.
8. Limitation of Liability
To the fullest extent permitted by law, Built By Micah is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or our services. Our total liability for any claim related to the Site or our services is limited to the amount you paid us, if any.
9. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect and handle your information.
10. Governing Law
These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-law principles. Any disputes relating to a project or automation service will be handled as described in your signed agreement, where applicable.
